Making an Enduring Power of Attorney enables you to select the appropriate individuals to manage your affairs in the event that you become unable of doing so yourself. Sherlock and Co Solicitors Clondalkin can help you through this process.

WHAT IS AN ENDURING POWER OF ATTORNEY?

A Durable Power of Attorney is a signed and witnessed instrument that enables a client (Donor) to designate a certain party (ies)  referred to as Attorney/Attorneys. A Donor’s Attorney/Attorneys will have the ability to make choices regarding their property and care on their behalf.

It is critical to recognize that this power takes effect only if a client develops mental impairment. Before it is registered, an Enduring Power of Attorney may be revoked at any moment.

WHO ARE THE PARTIES TO AN PERMANENT AUTHORITY OF ATTORNEY?

The Donor is the party who grants the Enduring Power of Attorney. The parties entrusted with making decisions on behalf of  Attorneys are those who represent the Donor.

Additionally, the Donor must select at least two Notice Parties to whom a letter describing the Donor’s gift of an Enduring Power would be sent.

Additionally, a physician must verify that the Donor possesses the mental competence necessary to give an Enduring Power of Attorney.

To summarise, if you do not have an Enduring Power of Attorney and become mentally incompetent, an application to the High Court may be required to have you accepted into Wardship under the supervision of the Wards of Court office, which will cost your loved ones. In this case, the court has the authority to act on your behalf. An Enduring Power of Attorney avoids this predicament by granting you the authority to make decisions while you have cognitive capacity. Contact Sherlock and Co.
